What are the different classes of drugs in Scotland?

Drugs are classified A, B, or C based on their danger and potential harm. Cocaine, heroin, and ecstasy are considered Class A substances, which are the most hazardous. Class B drugs include cannabis, ketamine, and amphetamines (commonly known as speed).
Benzodiazepines, including diazepam and valium, are classified as Class C medicines.

What does it mean to be in Possession of Drugs?

The police have the authority to stop and search you if they have a reasonable suspicion that you are in possession of a prohibited substance. The penalty for possession of restricted substances varies according on the drug’s class and amount.

Possession, as defined by the law, is possessing narcotics on your person or in anything you own, such as your pocket, backpack, or automobile, even if the drugs are not yours.

If you have been charged with possession of a restricted substance, you have various options for defence. You must be able to convincingly argue one of the following:

  • You didn’t know or think you were in possession of a restricted substance.
  • If you were unaware that you were in possession of a prohibited substance, or if you thought you were legally in possession of a controlled drug but it turned out to be another substance that you didn’t have a licence or prescription for, you may be in violation of the law.
